Thanks for the A2A.It’s easy to file an EEOC claim.For myself, before I made a decision like that, I would want to do some analysis including:Was business recently lost (a closure of an area, plant, reducing product sales, etc.)?How was the decision about who would be laid off made (what criteria)? Were these people lower in seniority, had skills specific to the area where business was lost, etc.?Was the company consistent in application of the criteria?If business was lost and the criteria are ones that are widely used (like lowest in seniority), you could still file. However, I think that the company could probably show that, while unfortunate in minority impact, the decisions made were fair.Most businesses would have already given thought to who would be impacted by a layoff. I think that they also would have realized that there is a disparate impact by race. That doesn’t mean that the layoff and who was laid off is not the right decision.If I felt that race might have been a primary factor, I would probably ask to speak with the HR manager or the leader of the plant, etc., affected. It would be helpful for you if this was someone you trusted (but you can’t always have what you want). I would simply ask:What were the criteria for determine who was laid off and were any other criteria considered?Then I would just state that I was concerned about the number of minority employees impacted was x% of the total while minority’s are X% of the plant, organization, etc. Was that realized and considered as this decision was made?Then you have to decide for yourself if the reason is correct and the criteria were typical of other businesses.Bottom line - if they have a rational reason for the layoff and who was selected, this claim probably won’t make it.You should feel free to talk with an attorney or the EEOC about your questions, too.I really am sorry for the people who lost their jobs and hope they have the skills and opportunity to find better jobs soon!
